COVID 19 Liability Defenses and Risk Management Strategies. In this program KAMMCO Vice President of Claims, Jennifer Sherber will review House Bill 2016- COVID-19 Response and Reopening for Business Liability Protection Act; in relationship to adult care facilities. Jennifer will discuss portions of the bill that will impact liability defenses available to adult care facilities. 

Connie Christian, Facility Risk Management and Patient Safety Advisor will discuss Risk Management strategies to assist facilities in current policy/procedure review and how to move forward with implementing new and updated regulations into current daily care operations. Connie will also discuss the points of critical documentation in the COVID 19 environment and appropriate disclosure conversations to protect staff and the facility while making sure the patient and family understand and are confident with how an event has unfolded.

OBJECTIVES:  At the end of this program participants will:

  • Understand how the COVID-19 Response and Reopening for Business Liability Protection Act may apply to their facilities.
  • Understand what “affirmative defense” is and how it may be used to defend a COVID 19 claim.
  • Be able to review current policies and procedure against the new regulations and make appropriate changes as necessary.
  • Discuss with staff members the importance of documentation and critical documentation areas for COVID 19 issues.
  • Review with staff members appropriate conversations during disclosure of unintended or adverse events to patients and family.
