On March 1, HHS officially transmitted the Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting rule (CMS-3442) to the Office of Management and Budget’s Office of Information and Regulatory Affairs (OIRA). Transmitted as a final rule, OIRA has up to 90 days to review the rule, a period it can extend; there is no minimum review period. The OIRA review includes an analysis of the costs and benefits of the rule and a determination that the rule’s benefits justify its costs.
