The U.S. Department of Health and Human Services (HHS) on November 1st published a proposed rule for public comment that would establish disincentives for health care providers found by the HHS Office of Inspector General (OIG) to have committed information blocking under the 21st Century Cures Act. The HHS Office of the Inspector General is responsible for determining whether a provider committed information blocking.
Information blocking by a healthcare provider means they engaged in a practice they know is likely to interfere with the access, exchange, or use of electronic health information. The rule is open for public comment through January 2, 2024. LeadingAge will analyze the rule and its potential impact on members and will provide additional information in the weeks ahead.
