Just a reminder that while the PHE waiver of the 3-day stay requirement for Medicare FFS beneficiaries has ended, certain Accountable Care Organizations (ACOs) and Medicare Advantage (MA) and Special Needs Plans (SNPs) still have this authority. ACOs taking both upside and downside risk have this authority to waive the 3-day stay requirements for all the Medicare FFS beneficiaries attributed to them. However, the waiver can only be used with the ACO’s SNF affiliates. MA and SNP plans can also waive 3-day stays but use this authority to varying degrees around the country.
