Last week, staff joined a KDADs Stakeholder call to receive updates regarding nursing home data, policy changes, and Medicaid redeterminations. Below are a few highlights discussed on the call. 

  •  Licensure Update for Q1 included one change of ownership, four openings, and three closures. There were 5 IDRs that were disputed and upheld, with 6 DPNAs effectuated. There were 17 NF per instance CMPs issued with an average amount per CMP: $11,865.29 and 10 NF per day CMPs issued with an average amount of $7,593.55. 
  • CMS issues Final Settings Rule Heightened Scrutiny reports for some Kansas assisted living facilities, with more to come. KDADs now has 30 days to respond with a plan to come into compliance, and the agency is still determining the number of days it will allow providers to adhere to the plan and continue offering HCBS. The Corrective Action Plan will be made available on the agency website after it is sent to CMS. We are beginning to collaborate with our national partners on how to address concerns surrounding the Final Settings Rule for AL. 

Medicaid renewal redeterminations will continue to make process changes to make allowances for delayed submissions. If individuals do not have their paperwork back to the state agency by the 15th of each month, they will lose their coverage on the 1st of the following month. If paperwork was sent back late, those submissions will be processed on a rolling basis and allowed to be backdated for coverage.
