The Wage & Hour Division of the U.S. Department of Labor (DOL) published a proposed rule on September 8th that would revise federal regulations relating to exemption from overtime pay requirements for executive, administrative, and professional employees under the Fair Labor Standards Act.  DOL is proposing to significantly increase both the standard salary level required for exemption and the highly compensated employee total annual compensation threshold, and to establish a system for automatically updating these thresholds on a regular basis going forward.

The proposal is open for public comment through November 7th, and LeadingAge will work with members to analyze the rule’s impact and develop comments for submission to the Department. This article provides a detailed summary of the proposed rule, and this DOL webpage includes a link to the proposed rule, as well as a Frequently Asked Questions document.
