Congressman Roger Marshall recently stepped forward as one the first co-sponsors of HB 6986. This bill that makes important changes to the long-standing federal law that requires a 2-year ban on CNA training for nursing homes under certain circumstances. With HB 6986, the state would have discretion to apply the ban (as opposed to mandated by federal law) and the ban would be rescinded as soon as the deficiency or deficiencies in question have been corrected. It is an important reform of the survey and enforcement process that can only be made through an act of Congress. It is a small step, but extremely important as a “nose under the camel’s tent” in the quest to bring sanity to the oversight of nursing homes.
