The following statistics reflect the experience by Kansas Aging Service Providers covered by the Health Care Stabilization Fund (HCSF).
To date 47 claims against adult care homes involving care provided on and after January 1, 2015 have been reported to the Fund.
- 4 claims against Assisted Living Facilities
- 2 claims against Residential Health Care Facilities
- 41 claims against Nursing Homes
Of the 47 claims, 17 are closed and 30 are pending.
Of the 17 closed claims:
- 8 claims were dismissed or the claim denied with no payment.
- 9 claims were resolved by settlement. None of the settlements involved payment from the HCSF.
In one of the pending claims, the nursing home’s primary insurance carrier has tendered their coverage limits to the Fund. One of the pending claims is against an inactive nursing home. Therefore, the Fund is providing “tail” coverage for this claim. A settlement has been reached, but not yet approved by the court. (This will be the first claim in which the Fund has made a payment on behalf of a nursing home.)
