Update on State-Led Lawsuit Challenging CMS Staffing Standard
The LeadingAge state affiliates and state Attorneys General that have joined in a suit to challenge the CMS nursing home staffing standard filed a motion for a preliminary injunction on October 22. In keeping with the established schedule in the case, on November 21 the Department of Justice (DOJ) filed a memorandum in opposition to the plaintiffs’ motion on behalf of the U.S. Department of Health and Human Services and Centers for Medicare and Medicaid Services. The plaintiffs’ will submit a reply to the DOJ’s filing on November 27, and Judge Leonard Strand will hold a hearing with oral arguments from the parties on December 5.
