KDADS Accepting Public Comment on HCBS Background Check Policy

The newest draft of the HCBS Background check policy from KDADS will require employers to check:

  • The Office of Inspector General (OIG) website online database to check for the list of excluded entities and individuals
  • The Kansas Nurse Aid Registry check through KDADS HOC website
  • The KDOR website for a Driver’s License Records Request – at the employer’s own expense – but this is only a requirement if the HCBS employee is transporting any HCBS waiver participants
  • The Child Abuse, Neglect, and Exploitation registry through Kansas DCF website
  • The Adult Abuse, Neglect, and Exploitation registry through the Kansas DCF website
  • The National Sex Offender Registry through the National Sex Offender Registry website

The background checks must be completed every two years. The main differences in the updated policy include provisional hiring requirements and exceptions for self-directed HCBS employees.

Review the draft policy here and provide comments directly to KDADS through their website, or send your feedback to Kylee Childs
