The FY 2025 SNF PPS proposed rule includes a provision that would give CMS authority to enforce more civil money penalties (CMPs) against nursing homes. If finalized, CMS could enforce multiple CMPs per survey and both per instance and per day CMPs in the same survey and for the same type of noncompliance. CMS would also have the authority to extend a per day CMP as far back as the last three standard surveys.  

Comments on these provisions are due by Tuesday, May 28. As of May 17, only 31 comments have been submitted to the Federal Register and only one of these 31 comment letters opposes the CMP expansion. Act now! Use this Action Alert to tell CMS: DO NOT FINALIZE EXPANSION OF CMP AUTHORITY!
