It highlights our position that the Home and Community-based settings rule — initially proposed in 2008, finalized in 2014, and requiring full compliance as of March 2023 — isn’t a good fit for aging services providers. In the paper, we outline examples of why the rule doesn’t support the needs of aging participants or providers in the Medicaid HCBS program. We suggest a two-year enforcement moratorium while CMS reviews and disseminates compliance guidance for aging services providers.
