Today, representatives from CMS reviewed slides outlining states’ opportunities and actions regarding the upcoming compliance date of March 17, 2023 with the HCBS Settings Final Rule. During the question-and-answer portion, Melissa Harris of CMS noted that providers billing Medicaid in states with approved corrective action plans (CAPs) could still be paid for administered services. Additionally, it was noted that 40 of 51 states/jurisdictions either have or are anticipated to have approved CAPs. The ongoing workforce shortage remains the primary reason CMS is approving CAPs.
