Question: If a nursing home has a “salon” that only serves residents, and services are performed by a licensed stylist they contract with — does the “salon” have to be licensed by the Kansas board of cosmetology?
Answer: No. While a nursing home may have a room marked as a salon, barber shop or beauty parlor, it is not a space that serves the public or meets any other traditional definition of a salon. In fact, it is a dedicated space and service that exists to meet the state’s nursing home physical environment regulations, specifically the requirement found in K.A.R. 26-40-302(g)(4)(A).
In general, the Board of Cosmetology requires a licensed cosmetologist to operate out of a licensed salon. However, the Board of Cosmetology waives that requirement for a licensed cosmetologist who provides services in a hospital, nursing home, rest home or at an invalid’s home.
