HCBS Final Settings Rule: Remediation Notices

It seems providers have started to receive remediation notices related to the HCBS Final Settings Rule which will primarily impact state licensed only providers, outside of nursing home settings, that accept HCBS. Some of the frequent items we anticipate seeing across all these notices are related to freedom of choice and mobility or allowing HCBS residents to go where they want, whenever they want and having a residency agreement with landlord tenant and appeals protections that is separate from a negotiated service agreement. As providers receive these remediation notices, please share them with Kylee. We are still looking at advocacy options related to this rule.

Testimony Needed on Health Survey Issues for Legislative Hearing

We are gathering testimony on experiences with KDADS for health survey. Whether your testimony is based on inconsistencies in enforcement, contradictions between health and life safety code, timely communication, lack of collaboration, the IDR process, or something else – we want to hear from you. The hearing is for the Special Health and Social Services Committee on Wednesday, October 1. We are seeking enough testimony to fill up an hour in the afternoon – roughly 12 individuals. If you have an experience you’d like to share, please email Kylee by next week Friday, September 26. Virtual and in-person testimony is an option, as well as written only.
