Kansas, et al. v. Becerra Staffing Rule Lawsuit Update 

The coalition of 20 state attorneys general and 17 LeadingAge state affiliates, representing 21 states, and 2 Kansas nursing home providers filed a motion for preliminary injunctive relief on October 24. 

What does this mean? Each of the plaintiffs in the case filed Declarations of Harm outlining how the rule is currently negatively impacting their operations and residents, primarily through financial burden associated with the enhanced facility assessment and beginning to staff higher to meet the rule in the next couple years. The plaintiffs are asking the judge to rule in their favor and stop the rule from being implemented and enforced until a final decision on the rule is made. There are no scheduling orders to share at this time. We will share more information as the case proceeds forward.
