The week of August 13 brought two legal developments relating to the CMS final rule establishing minimum staffing standards for long-term care facilities.
First, the United States District Court for the Northern District of Texas has approved a schedule of activities in the lawsuit in which LeadingAge is a co-plaintiff, laying out a timeline for each party’s arguments to be submitted for review and consideration, which will position the Court to issue a decision.
In a separate development, Texas Attorney General Ken Paxton filed a second lawsuit – also in the U.S. District Court for the Northern District of Texas – challenging the CMS staffing requirements. LeadingAge has updated their Nursing Home Staffing Mandates Serial Post to include these developments.
