The Centers for Medicare & Medicaid Services (CMS) updated interpretive guidance on June 18 to reflect enhanced Facility Assessment requirements as finalized in the May 10 Minimum Staffing Standards rule. The guidance outlines changes to the Requirements of Participation, with Facility Assessment requirements being moved from 42 CFR 483.70 Administration to a new section 42 CFR 483.71 Facility Assessment. The guidance also addresses updates to existing federal tag F838 under which these requirements will be surveyed including definitions, the intent of the requirements, investigative procedures, key elements of noncompliance, and examples of noncompliance.
