On June 24, CMS published corrections to the Medicare and Medicaid Programs; Minimum Staffing Standards for Long-Term Care Facilities and Medicaid Institutional Payment Transparency Reporting Rule. The June 24 document corrects technical errors in the Minimum Staffing final rule and does not make substantive changes.  

One item of note in the corrections is the completion of TABLE 2 on page 40898, which describes criteria to be eligible for the statutory waiver. In the May 10 final rule, the table was not complete on facility type, NFs and SNFs and the correction document completes the table stating the full requirements of the waiver. The table offers clarity to the final rule’s provisions by reiterating them; it does not include new requirements. The June 24 correction also provides corrected links for the May 2022 National Occupational Employment and Wage Statistics. All corrections in the document have the effective date of June 21, 2024.
