On May 10, Representatives Michelle Fischbach (R-MN) and Greg Pence (R-IN) introduced a Congressional Review Act (CRA) resolution of disapproval to overturn the final minimum staffing rule. The resolution was introduced the same day the final rule was published in the Federal Register. The CRA is a tool Congress can use to overturn a final rule released by a federal agency. Previously considered legislation would have pre-emptively blocked implementation of the proposed minimum staffing rule. However, the May 10 CRA resolution of disapproval, if signed into law, would be used to prohibit implementation of the final minimum staffing rule and prevent CMS from issuing a substantially similar rule. LeadingAge worked closely with Representatives Fischbach and Pence on the introduction of the CRA resolution and we continue discussions on the introduction of a Senate companion.
