On February 16th, Representative Eric Burlison (R-MO) introduced the Overtime Pay Flexibility Act, which would prevent the U.S. Department of Labor’s (DOL) proposed overtime rule from taking effect. The Department’s proposal, released in September 2023, would significantly increase the threshold salary level required for an individual performing administrative, executive, or professional duties to be exempt from overtime, and it would establish a system for automatically updating these thresholds on a regular basis going forward.  

In a statement, Rep. Burlison noted that, if finalized, the proposed rule would impose significant regulatory compliance burdens and higher costs on businesses while also limiting workplace flexibility for employees. This LeadingAge article provides background on the proposed rule, along with a summary of our comments on the proposal.
