The U.S. Department of Labor recently issued a final rule on the overtime threshold for exempt employees under the Fair Labor Standards Act. The Final Rule sets the minimum salary threshold for the “white collar” exemptions, which will increase to $35,568 annually ($648 per week). The Final Rule goes into effect January 1, 2020.The exemption threshold for highly compensated employees is now set at $107,432, up from the previous threshold of $100,000.The Final Rule does not make any changes to the “duties test” under the FLSA for determining whether an employee is exempt.
